1. Acceptance of Terms

Welcome to BakeryFlow ("we," "our," or "us"). By creating an account, accessing, or using the BakeryFlow mobile application and website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

BakeryFlow is a platform designed to help home bakers and micro-bakeries manage their operations, specifically for preorder-based "drops" or "bake days." The Service provides tools for creating product catalogs, minimizing administrative tasks, managing orders, and organizing pickup windows.

3. Eligibility and Accounts

• Age Requirement: You must be at least 18 years old to use the Service. By creating an account, you represent and warrant that you meet this age requirement.
• Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
• Account Information: You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

4. User Content and Conduct

• Ownership: You retain ownership of all text, images, photos (including product and drop images), price lists, and other materials ("User Content") that you upload to the Service.
• License to Us: By uploading User Content, you grant BakeryFlow a worldwide, non-exclusive, royalty-free license to use, host, store, reproduce, modify, create derivative works (such as resizing images), and display your User Content solely for the purpose of operating, promoting, and improving the Service.
• Prohibited Content: You agree not to upload User Content that is illegal, offensive, threatening, defamatory, infringes on intellectual property rights, or violates any applicable food safety laws or cottage food regulations in your jurisdiction.
• Prohibited Activities: You agree not to:
  • Use the Service for any illegal purpose.
  • Attempt to reverse engineer, decompile, or hack the Service.
  • Harass, abuse, or harm another person or group.
  • Interfere with the proper operation of the Service.

5. Subscriptions and Payments

• Service Fees: BakeryFlow may offer certain features through paid subscriptions ("Premium Features"). Payments for these subscriptions are processed through RevenueCat via the Apple App Store or Google Play Store.
• Baker-Customer Transactions: BakeryFlow merely facilitates the organization of orders. We are not a party to the transactions between bakers and their customers. We do not process payments for baked goods directly. Any payment arrangements (e.g., Cash, Venmo, Zelle) are solely between the baker and the customer.
• Refunds for Service: Refunds for BakeryFlow app subscriptions are handled according to the policies of the respective app store (Apple or Google).

6. Food Safety and Compliance

• Baker Responsibility: You acknowledge that you are solely responsible for ensuring that your baking operations, products, and sales comply with all applicable local, state, and federal laws, including "Cottage Food Laws" and health department regulations.
• Disclaimer: BakeryFlow is a software tool, not a food safety authority. We explicitly disclaim any liability for the safety, quality, or legality of the products sold by bakers using our Service.

7. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of BakeryFlow and its licensors. The Service is protected by copyright, trademark, and other laws of the United States and foreign countries.

8. Third-Party Links and Services

The Service may contain links to third-party web sites or services that are not owned or controlled by BakeryFlow. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party web sites or services.

9. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

10. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall BakeryFlow, its affiliates, agents, directors, employees, suppliers, or licensors be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, the Service.

11. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of Wyoming, United States, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
